BTI (Binding Tariff Information) is an official EU customs decision confirming the classification of goods. Valid for 3 years, binding across all EU member states.

Scope of classification under CN 9022 19 - non-medical X-ray apparatus

Subheading 9022 19 of the Combined Nomenclature covers all X-ray apparatus intended for purposes other than medical, surgical, veterinary and dental use. Products classified here include: security and screening systems - X-ray gateways and tunnel screening systems for hand luggage and checked baggage at airports and seaports (used by customs and security authorities), vehicle and container inspection systems (stationary and mobile drive-through X-ray portals with linear detector arrays), non-destructive testing and evaluation (NDT/NDE) apparatus used in aerospace, energy, construction and shipbuilding industries for weld inspection, flaw detection and thickness measurement in pipelines, pressure vessels and structural components, industrial and laboratory micro-CT systems for three-dimensional imaging of component internal structures and electronic assemblies, inline X-ray inspection systems for food quality control detecting foreign bodies such as bone fragments, metal and glass, X-ray fluorescence (XRF) spectrometers for elemental composition analysis of metals, soils, minerals and coatings, and X-ray systems for art examination, archaeological investigation and document authentication. The distinction from medical (9022 14) and dental (9022 13) apparatus rests solely on the intended purpose - technically identical equipment is classified to different subheadings depending on the purpose of use declared by the manufacturer. Classification follows GRI 1 and 6 of the Combined Nomenclature and notes to Section XVIII and Chapter 90. In cases of doubt, particularly for multi-purpose apparatus, Binding Tariff Information (BTI) ruling is strongly recommended.

Regulatory framework and import requirements for industrial X-ray apparatus

Industrial and security X-ray apparatus under CN subheading 9022 19 is not a medical device and does not fall under Regulation (EU) 2017/745 (MDR). It is however subject to general product safety legislation: Regulation (EU) 2023/988 on general product safety (for consumer-facing products), the Low Voltage Directive (LVD 2014/35/EU) and the EMC Directive (2014/30/EU) - the product must carry CE marking and be accompanied by an EU Declaration of Conformity. Industrial NDT apparatus and baggage screening systems must also comply with specific electrical and mechanical safety standards including EN 61010 (safety requirements for electrical equipment for measurement and control), EN 62368 or equivalent. The primary regulatory framework governing use of the equipment is Council Directive 2013/59/Euratom (Basic Safety Standards - BSS), transposed into national radiation protection law across EU Member States. Installation and operation of industrial X-ray generators requires notification or authorisation from the competent nuclear and radiation protection authority (in Poland: the President of the PAA, for radiation sources exceeding defined activity thresholds). Radiation workers must be subject to individual dosimetric monitoring. The working area of the apparatus must be appropriately designated, shielded and marked with ionising radiation warning signs to prevent uncontrolled exposure. Baggage screening systems deployed at airports must additionally comply with EU aviation security regulations and standards established by the European Civil Aviation Conference (ECAC). Importers must hold a valid EORI number and file an electronic customs declaration with the correct 8-digit CN code. Required import documents include a commercial invoice with technical description and customs value, transport document, EU Declaration of Conformity, electrical safety certificates, radiation parameter specification sheet, and - for preferential duty rates - a valid proof of origin.

Customs duty rates and trade agreements for subheading 9022 19

Non-medical X-ray apparatus under CN subheading 9022 19 encompasses a wide range of products from security inspection systems to industrial NDT equipment and laboratory instruments - categories with diverse trade values and a broad range of countries of origin. The applicable MFN duty rate for specific 8-digit CN codes under subheading 9022 19 must be verified in the current TARIC database of the European Commission, as both the nomenclature and applicable rates are subject to annual revision. The EU may apply autonomous tariff suspensions for selected research and industrial apparatus that cannot be obtained in the EU market in sufficient quantities - these suspensions are updated annually by the Council of the EU by regulation. Leading manufacturers of baggage screening and NDT systems are located in the United States, Germany, Japan, Israel and China. Preferential duty rates may be available under EU free trade agreements including the EU-Japan EPA, CETA with Canada, the EU-UK TCA, the EU-Korea FTA and the EU-Switzerland agreement. GSP and GSP+ preferences apply to eligible imports from developing countries. Application of a preferential rate requires presentation of a valid proof of origin: EUR.1 movement certificate, invoice declaration or REX exporter statement. Importers should check TARIC for any anti-dumping measures applicable to the specific country of origin. Products in Chapter 90 are not subject to the CBAM mechanism. VAT is applied on the customs value at the rate applicable in the importing country for the relevant product category. Given the high unit values of security screening and industrial NDT systems, accurate tariff classification and duty rate determination are commercially significant.

Industrial X-ray CN 9022 19 - NDT and security scanning

Subheading CN 9022 19 covers X-ray apparatus for non-medical uses: industrial defectoscopes (NDT), baggage and cargo scanners (airports, ports), veterinary X-ray, and security screening systems. NDT defectoscopes used in aviation and energy are subject to ISO 17636 quality controls. Baggage scanners comply with ECAC and TSA standards. Duty rate: 0%. Import requires EURATOM compliance.

Frequently asked questions

What products are classified under CN subheading 9022 19?
CN subheading 9022 19 covers all X-ray apparatus for purposes other than medical, surgical, veterinary and dental use. Products classified here include airport and customs baggage screening tunnel systems, vehicle and container drive-through X-ray portals, NDT X-ray apparatus for industrial weld and flaw inspection in aerospace and energy sectors, industrial micro-CT systems for three-dimensional component analysis, inline X-ray food inspection systems for foreign body detection, XRF spectrometers for elemental analysis of metals and materials, and X-ray systems for art and archaeological examination. Medical and veterinary apparatus is classified under 9022 14; dental apparatus under 9022 13.
Is industrial NDT X-ray apparatus subject to radiation protection requirements in the EU?
Yes. Industrial X-ray NDT apparatus and baggage screening systems under subheading 9022 19 are subject to Council Directive 2013/59/Euratom (BSS), transposed into national radiation protection law across EU Member States. Installation and operation of an X-ray generator requires notification to or authorisation from the competent nuclear and radiation protection authority (in Poland: the President of the PAA). The working area must be properly shielded, marked and zoned, and personnel operating the apparatus must be subject to individual dose monitoring. Uncontrolled emission of X-radiation outside the designated area is prohibited. Non-compliance with BSS requirements is subject to administrative and criminal sanctions under national law.
What documents are required to import a baggage X-ray screening system into the EU?
Importing a baggage or container X-ray screening system under subheading 9022 19 requires a commercial invoice with technical description and customs value, transport document (CMR, AWB or B/L), EU Declaration of Conformity (CE) with technical documentation demonstrating compliance with the LVD and EMC Directives, electrical safety certificates, a radiation parameter specification sheet, and the importer's EORI number. For preferential duty rates under an FTA, a valid proof of origin (EUR.1, invoice declaration or REX) is required. Installation additionally requires separate notification to or authorisation from the national radiation protection authority. Current import requirements should be verified in the EU TARIC database before each import transaction.
Are airport baggage scanners classified under CN 9022 19?
Yes, X-ray baggage scanners (airport, port) are classified under CN 9022 19 as non-medical X-ray apparatus. They are subject to ECAC standards for detecting hazardous materials and are also covered by EURATOM radiation protection regulations.
