BTI (Binding Tariff Information) is an official EU customs decision confirming the classification of goods. Valid for 3 years, binding across all EU member states.

Description and tariff classification

CN code 540743 covers woven fabrics of yarn of nylon or other polyamides, of yarns of different colours, containing 85 percent or more by weight of polyamide fibres. Yarn-dyed fabrics are produced by weaving with yarn dyed before the weaving process, enabling the creation of check, stripe, and jacquard patterns. These fabrics are valued in fashion, upholstery, and the production of ties, scarves, and formal wear. Classification requires confirmation that the pattern was created from yarn dyed before weaving, not by printing or piece dyeing. The polyamide content must be at least 85 percent by weight.

REACH, GPSR and textile standards

Yarn-dyed fabrics are subject to REACH regarding dyes and chemical substances. Each yarn colour must comply with requirements for azo dyes and restricted substances. Regulation EU 1007/2011 requires fibre composition labelling. GPSR imposes safety and traceability requirements. Multi-colour fabrics may require more extensive laboratory testing, as each yarn colour may contain different dyes. The importer should obtain documentation from the manufacturer confirming compliance of each dye used with REACH requirements.

Customs procedures and trade

The customs declaration for fabric imports under CN code 540743 should include raw material composition, area weight, weave type, width, pattern and colour description, and confirmation that the pattern was created from dyed yarn. Classification of yarn-dyed fabrics requires distinction from piece-dyed and printed fabrics, which may require technical expertise. Preferential duty rates are available under FTA agreements with double transformation rules of origin. High-quality yarn-dyed fabrics, such as jacquards, are often imported from Italy, France, and Turkey.

Importing synthetic woven fabrics - duties CN 5407 43

Synthetic woven fabrics CN 5407 43 are classified by polymer type (nylon, polyester), treatment (unbleached, dyed, printed), and composition. Import into the EU is subject to conventional customs duty and import VAT. Fibre composition labelling under EU 1007/2011 is mandatory. Average duty rates are several percent.

Frequently asked questions

How to distinguish yarn-dyed fabric from printed fabric?
Yarn-dyed fabric shows a pattern visible on both sides with equal intensity, as colour is an integral part of the yarn. Printed fabric has a pattern more clearly visible on one side where the ink was applied. Microscopic yarn cross-section analysis allows definitive distinction between both types.
Are nylon jacquard fabrics classified under code 540743?
Yes, if the jacquard fabric is made from polyamide yarn of different colours and contains at least 85 percent by weight of polyamide. However, jacquard fabrics may also be classified under code 540730 if they meet the criteria of Note 9 to Section XI.
What laboratory tests are required for multi-colour fabrics?
Multi-colour fabrics require testing of each yarn colour for azo dyes according to EN 14362. Additionally, colour fastness tests for rubbing, washing, and light may be required. Each colour is treated as a separate sample in laboratory testing.
What is the EU duty on yarn-dyed nylon woven fabric CN 5407 43?
Yarn-dyed nylon woven fabric under CN 5407 43 is subject to conventional EU customs duty and import VAT. Check the rate in TARIC. Fibre composition labelling per EU 1007/2011 is mandatory.
