BTI (Binding Tariff Information) is an official EU customs decision confirming the classification of goods. Valid for 3 years, binding across all EU member states.

Classification and product scope

CN code 540742 covers woven fabrics of yarn of nylon or other polyamides, dyed, containing 85 percent or more by weight of polyamide fibres. Dyeing of nylon fabric takes place after the weaving process, as distinct from yarn-dyed fabrics classified under a separate code. Dyed polyamide fabrics find wide application in outerwear, sportswear, upholstery materials, and technical fabrics. Dyeing provides colour uniformity across the entire fabric surface. Classification requires confirmation that the polyamide content is at least 85 percent by weight and that the fabric has been dyed rather than printed or woven from coloured yarn.

REACH, EU 1007/2011 and GPSR regulations

Dyed nylon fabrics imported into the EU are subject to REACH regarding chemical substances used in dyeing. Particular attention must be paid to azo dyes releasing carcinogenic aromatic amines covered by entry 43 of Annex XVII to REACH. The permissible limit for aromatic amines is 30 milligrams per kilogram. Regulation EU 1007/2011 requires fibre composition labelling. GPSR imposes product safety and supply chain traceability obligations. The importer should hold laboratory test results confirming dye compliance with REACH requirements, conducted according to EN 14362 standard.

Trade and customs procedures

The customs declaration for fabric imports under CN code 540742 must include raw material composition, area weight, weave type, width, colour, and confirmation that the fabric is dyed. Customs authorities may take samples for laboratory analysis. Duty rates on dyed fabrics may differ from rates on unbleached or bleached fabrics. Preferential duty rates are available under FTA agreements provided rules of origin requiring double transformation are met. Export of dyed nylon fabrics from the EU generally does not require special permits unless the destination country applies restrictions on chemical substances.

Importing synthetic woven fabrics - duties CN 5407 42

Synthetic woven fabrics CN 5407 42 are classified by polymer type (nylon, polyester), treatment (unbleached, dyed, printed), and composition. Import into the EU is subject to conventional customs duty and import VAT. Fibre composition labelling under EU 1007/2011 is mandatory. Average duty rates are several percent.

Frequently asked questions

Which dyes are prohibited in fabrics under code 540742?
Azo dyes releasing carcinogenic aromatic amines listed in entry 43 of Annex XVII to REACH are prohibited. The list includes 24 aromatic amines such as benzidine, 4-aminobiphenyl, and 2-naphthylamine. The limit is 30 milligrams per kilogram of fabric. Testing is performed using the EN 14362 method.
Do duty rates differ for dyed versus unbleached fabrics?
Yes, duty rates may differ depending on the fabric's degree of finishing. Dyed fabrics under code 540742 may have a different conventional rate than unbleached fabrics under code 540741. Current rates should be verified in the TARIC database by entering the appropriate CN code.
How to prove a fabric is piece-dyed rather than yarn-dyed?
Piece-dyed fabric has uniform colour on warp and weft, while yarn-dyed fabric may show different coloured threads. Customs authorities may conduct microscopic cross-section analysis of the yarn to determine whether the dye has penetrated uniformly throughout the entire fibre.
What is the EU duty on dyed nylon woven fabric CN 5407 42?
Dyed nylon woven fabric under CN 5407 42 is subject to conventional EU customs duty and import VAT. Check the rate in TARIC. Fibre composition labelling per EU 1007/2011 is mandatory.
