Einreihung und Merkmale von Aluminium-Flitterpulver - 7603 20
Die Unterposition 7603 20 der Kombinierten Nomenklatur umfasst Aluminiumpulver mit Lamellenstruktur, im Handel bekannt als Aluminiumpaste oder Aluminiumflitterpulver. Die plättchenartige (lamellare) Partikelstruktur unterscheidet dieses Erzeugnis von den kugelförmigen Pulvern der Unterposition 7603 10. Flitter entstehen durch Nass- oder Trockenmahlen von Aluminiumgranulat oder -formteilen in Kugel- oder Attritormühlen. Die plättchenförmigen Partikel zeichnen sich durch ein hohes Oberflächen-zu-Masse-Verhältnis, metallischen Glanz und die Fähigkeit aus, schützende und dekorative Schichten in Lackierungen zu bilden. Aluminiumpaste ist eine Suspension von Flitterpulver in einem organischen Lösungsmittel oder einem wasserbasierenden Träger - sie ist ein wesentliches Pigment in Dekorlacken, Automobillacken, Schutzlacken und Druckfarben, die einen Metalleffekt erfordern. Trockenes Aluminiumflitterpulver wird u.a. in Pulverlacken, Pyrotechnik, Kunststoffen und Porenbeton eingesetzt. Die Einreihung erfordert eine Beurteilung der Partikelmorphologie anhand eines technischen Datenblatts mit Angaben zur Partikelform (D50-Wert, Aspektverhältnis). Der Einführer sollte zwischen Flitterpulver (7603 20) und kugelförmigem Pulver (7603 10) sowie zwischen Aluminiumpasten mit hohem Aluminiumgehalt unterscheiden, bei denen die Gesamtzusammensetzung und Form die Einreihung bestimmen.
Importanforderungen, REACH und CBAM für Unterposition 7603 20
Die Einfuhr von Aluminium-Flitterpulver der Unterposition 7603 20 in die Europäische Union erfordert eine Zollanmeldung mit dem richtigen KN-Code und der EORI-Nummer des Einführers. Die erforderlichen Einfuhrunterlagen umfassen eine Handelsrechnung mit technischen Parametern (Korngröße, Al-Gehalt, Trägertyp bei Pasten), Beförderungsdokument, Sicherheitsdatenblatt (SDB) gemäß CLP-Verordnung (EG) Nr. 1272/2008 und REACH, technische Spezifikation sowie Ursprungsnachweis bei Inanspruchnahme von Präferenzzollsätzen. Seit dem 1. Januar 2026 unterliegen Aluminium und Aluminiumerzeugnisse des KN-Kapitels 76, einschließlich Aluminium-Flitterpulver, der vollständigen CBAM-Pflicht (Carbon Border Adjustment Mechanism) gemäß Verordnung (EU) 2023/956. Der Einführer muss sich als zugelassener CBAM-Anmelder registrieren, vierteljährliche CBAM-Erklärungen zu eingebetteten Emissionen einreichen und die entsprechende Anzahl von CBAM-Zertifikaten erwerben. Aluminiumpaste und -pulver sind chemische Stoffe, die der REACH-Verordnung (EG) 1907/2006 unterliegen - der Einführer sollte die Registrierung des Stoffes in der ECHA-Datenbank und etwaige Beschränkungen nach Anhang XVII prüfen. Aktuelle MFN- und Präferenzzollsätze sind im TARIC-System der Europäischen Kommission verfügbar.
Handelsschutzmaßnahmen für Aluminiumpulver - Unterposition 7603 20
Aluminium-Flitterpulver aus China der Unterposition 7603 20 kann EU-Antidumpingmaßnahmen (AD) unterliegen. Der Einführer ist verpflichtet, den aktuellen Status der AD-Maßnahmen für den jeweiligen KN-Code und das Ursprungsland im TARIC-System vor der Einfuhr zu überprüfen. Aluminiumerzeugnisse des KN-Kapitels 76 können auch von EU-Schutzmaßnahmen in Form von Zollkontingenten (TRQ) erfasst sein - der Einführer sollte prüfen, ob ein aktives Quartalskontingent für diese Unterposition besteht und wie hoch die bisherige Ausschöpfung ist. Die Einfuhr von Aluminiumerzeugnissen aus Russland und Belarus kann Beschränkungen oder Verboten aus EU-Sanktionspaketen unterliegen. Präferenzzollsätze im Rahmen von EU-Freihandelsabkommen (CETA mit Kanada, JEFTA mit Japan, Abkommen mit Vietnam, Südkorea, Ukraine) können die Zollbelastung erheblich verringern, sofern die Ursprungsregeln eingehalten und ein gültiger EUR.1-Nachweis, eine Rechnungserklärung oder ein REX-Eintrag vorgelegt werden. Die Kosten für CBAM-Zertifikate sind bei der Kalkulation der Gesamtimportkosten zu berücksichtigen. Alle aktuellen Handelsschutzmaßnahmen sind im TARIC-System der Europäischen Kommission verfügbar.
Zolltarifliche Einreihung von Aluminiumpulver mit Lamellenstruktur (KN 7603 20)
Der KN-Code 7603 20 der Kombinierten Nomenklatur reiht Aluminiumpulver mit Lamellenstruktur in Kapitel 76 des EU-Zolltarifs für Aluminium ein. Die Einreihung richtet sich nach dem Verarbeitungsgrad (Rohaluminium, Halbzeug, Fertigerzeugnisse), der Legierungszusammensetzung (Reinaluminium, Legierungsreihen 1000-7000) und der Produktform (Blöcke, Stangen, Bleche, Folien, Rohre, Profile). Die Anmerkung 1 zu Kapitel 76 definiert Aluminiumlegierungen nach dem Mindestaluminiumgehalt. Aluminiumeinfuhren unterliegen TARIC-Regelzollsätzen und möglichen Antidumpingzöllen.

Welche REACH-Anforderungen gelten für die Einfuhr von Aluminiumpulver in die EU?
Aluminium und Aluminiumpulver sind chemische Stoffe, die der REACH-Verordnung (EG) 1907/2006 unterliegen. Ein Einführer außerhalb der EU wird rechtlich für die Registrierung des Stoffes verantwortlich, es sei denn, ein Alleinvertreter (OR) wird vom Nicht-EU-Hersteller bestellt.
