BTI (Binding Tariff Information) is an official EU customs decision confirming the classification of goods. Valid for 3 years, binding across all EU member states.

Definition and scope of subheading 8413 40

Subheading 8413 40 of the Combined Nomenclature covers concrete pumps, being equipment designed for pumping concrete mix through pipelines to construction sites. This includes stationary concrete pumps with hydraulic cylinders, truck-mounted concrete pumps with boom arms (concrete pump trucks), mortar and plaster pumps, and shotcrete pumps for sprayed concrete. The subheading covers both piston-type and screw-type pumps used for concrete transport. Classification requires the pump to be specifically designed for pumping concrete or construction mortar. General-purpose liquid pumps not designed for concrete are classified under other subheadings of heading 8413. Classification follows GRI Rules 1 and 6. Concrete pumps mounted on truck chassis are classified under 8413 40, not as special-purpose vehicles of Chapter 87. Where classification doubts arise, a BTI ruling is recommended.

Import requirements and regulations for concrete pumps (8413 40)

Importing concrete pumps under subheading 8413 40 into the European Union requires compliance with the Union Customs Code (Regulation (EU) No 952/2013). The importer must hold an EORI number and file a customs declaration with the correct CN code. Concrete pumps are subject to the Machinery Regulation (EU) 2023/1230, which establishes safety requirements for construction machinery. CE marking and an EU declaration of conformity including a risk assessment and user instructions in EU languages are mandatory. Concrete pumps with hydraulic pressure systems may be subject to the Pressure Equipment Directive (PED) 2014/68/EU for pressure components. Truck-mounted pumps are additionally subject to special vehicle registration requirements and road safety standards. Import documentation includes the commercial invoice, transport document, CE declaration of conformity, operating instructions and technical specification with pumping capacity data. MFN duty rates should be verified in TARIC.

Customs duties and trade measures for subheading 8413 40

MFN duty rates for concrete pumps under subheading 8413 40 should be verified in the TARIC database. Preferential rates may be available under EU FTAs. Applying preferential rates requires meeting rules of origin and presenting proof of origin. Concrete pumps are specialised construction equipment, and imports from China may receive particular attention from customs authorities given the significant share of Chinese manufacturers in the global market. Importers should check TARIC for anti-dumping or countervailing duties on construction machinery from the country of origin. Imports from Russia and Belarus are subject to EU sanctions restrictions. Import VAT is charged at the national rate. Used concrete pumps imported from non-EU countries are subject to the same customs procedures as new equipment. All rates and trade measures should be verified in TARIC before filing the customs declaration.

Concrete pumps - Machinery Directive and CE

CN code 8413 40 covers concrete pumps. Import into the EU is subject to TARIC duty rates and requires compliance with Machinery Directive 2006/42/EC. Pumps operating under pressure also fall under the Pressure Equipment Directive PED 2014/68/EU. Centrifugal pumps must meet ecodesign energy efficiency requirements. Customs clearance needs CE certificate and technical documentation.

Frequently asked questions

What does subheading 8413 40 of the EU tariff cover?
Subheading 8413 40 covers concrete pumps designed for pumping concrete mix through pipelines. It includes stationary pumps with hydraulic cylinders, truck-mounted concrete pump trucks with boom arms, mortar and plaster pumps, and shotcrete pumps. Both piston-type and screw-type pumps are covered. Truck-mounted concrete pumps are classified here, not under Chapter 87 as vehicles. Duty rates should be verified in TARIC.
What certifications are required for concrete pumps (8413 40)?
Concrete pumps under subheading 8413 40 are subject to the Machinery Regulation (EU) 2023/1230 and require CE marking, an EU declaration of conformity with risk assessment, and operating instructions in EU languages. Hydraulic pressure components may require PED 2014/68/EU compliance. Truck-mounted units require additional vehicle registration documentation. The importer must maintain complete technical documentation.
How are truck-mounted concrete pumps classified?
Truck-mounted concrete pumps (concrete pump trucks with boom arms) are classified under subheading 8413 40 as concrete pumps, not as special-purpose vehicles of Chapter 87 CN. The decisive criterion is the essential function of the equipment, which is concrete pumping rather than transport. The truck chassis serves merely as a mobile platform. Classification is confirmed under GRI Rule 1. Where doubts arise, a BTI ruling is recommended, and duty rates should be verified in TARIC.
What requirements must concrete pumps CN 8413 40 meet?
Concrete pumps CN 8413 40 must comply with Machinery Directive 2006/42/EC and, for pressure operation, PED 2014/68/EU. CE marking and a manufacturer's declaration of conformity are required.
