BTI (Binding Tariff Information) is an official EU customs decision confirming the classification of goods. Valid for 3 years, binding across all EU member states.

Classification of other track elements - CN 730290

CN code 730290 of the Combined Nomenclature covers other railway track construction elements of iron or steel not specified under subheadings 730210 (rails), 730230 (switching elements) and 730240 (fishplates and sole plates). These include check rails, guard rails (counter-rails), rail clips, adjustment wedges, guide rails, buffer stop components, insulated joints and other track superstructure parts. This is a residual subheading covering track elements that do not meet the criteria for more specific subheadings within heading 7302. Classification requires analysis of the element's function within the track structure and confirmation that it cannot be classified under a more specific subheading. Elements under 730290 are manufactured from structural steel or cast iron depending on their purpose and operational loads. Standards from the EN 13481 series (fastening systems) and EN 13230 (railway sleepers) may apply to certain elements covered by this subheading.

Import requirements and regulations for track elements CN 730290

Importing other railway track elements under CN code 730290 into the European Union is subject to Union Customs Code provisions and technical requirements under the railway interoperability directive (EU) 2016/797. Elements intended for EU railway infrastructure must comply with TSI and relevant European standards. CPR Regulation (EU) No 305/2011 may require CE marking for load-bearing elements. From 1 January 2026, imports may be subject to CBAM. Required documents include a commercial invoice with technical description (element type, purpose, dimensions, material, production standard), material certificate, transport documents and certificate of origin. Importers should ensure product compliance with national railway infrastructure manager requirements. Iron and steel products must comply with REACH. Correct classification under residual subheading 730290 requires ruling out the possibility of classification under more specific subheadings 730210-730240.

Trade defence measures for track elements CN 730290

Track elements under CN code 730290 are subject to EU safeguard measures on steel products in TRQ form with an additional 25% duty above the quota. Importers should verify the product category and current quota utilisation in TARIC. Anti-dumping duties may apply to track elements from China, India or Turkey - status should be checked in TARIC. Imports from Russia and Belarus are subject to EU sanctions prohibitions, which is significant given these countries' historical role as railway material suppliers. Preferential rates are available under EU free trade agreements provided rules of origin are met. Track elements are specialist products, often ordered to specific infrastructure manager requirements. Total import costs include MFN duty, any AD duties, safeguard surcharge, CBAM charges and VAT. Current rates and trade measures should be verified in TARIC.

Technical standards and certification for other railway track elements

Products classified under CN code 7302 90 (other railway track elements) must comply with applicable EU technical standards. Depending on their intended use, these may include harmonised EN standards for construction products (CPR Regulation 305/2011), the Machinery Directive or the Pressure Equipment Directive (PED). Construction products require CE marking and a Declaration of Performance (DoP). Customs authorities verify compliance with technical requirements during clearance and may withhold release of goods where required documentation or certificates are missing.
