EU003According to The Special Provisions of Section II (A) (3) of the Preliminary Provisions of the Combined Nomenclature the suspension of customs duties for goods for certain categories of ships, boats and other vessels and for drilling or production platforms shall be subject to conditions laid down in the relevant provisions of the European Union with a view to customs control of the use of such goods.

Classification scope of subheading 8525 89 - other television and digital cameras

Subheading 8525 89 of the Combined Nomenclature covers television cameras, digital cameras and other image recording devices that are not classified under more specific subheadings of heading 8525. In commercial practice, this subheading encompasses a wide spectrum of devices: IP cameras for CCTV surveillance systems, webcams, action cameras, studio and broadcast cameras, industrial endoscopic cameras and machine vision cameras. The key classification criterion is the device's ability to record or transmit video images, provided it does not qualify for any of the more specific subheadings (8525 81 for high-speed cameras, 8525 82 for infrared cameras, 8525 83 for night vision cameras). Digital still cameras without video capability are classified under heading 9006, not under 8525 89. Classification is based on the General Rules for the Interpretation of the CN (Rules 1 and 6) and the notes to Chapter 85. Where a device combines camera and other functions, classification follows the principal function rule under GIR Rule 3b. Drone cameras classified separately from the drone platform itself may fall under this subheading.

Regulatory requirements for importing digital cameras under subheading 8525 89

Television and digital cameras under subheading 8525 89 placed on the EU market are subject to the RoHS 2 Directive (2011/65/EU), which restricts the use of hazardous substances including lead, mercury, cadmium, hexavalent chromium, PBB, PBDE and four phthalates. The importer must hold a RoHS declaration of conformity and include it in the product technical documentation. Cameras equipped with wireless communication modules (Wi-Fi, Bluetooth, cellular connectivity) are subject to the Radio Equipment Directive (2014/53/EU), requiring conformity assessment, EU declaration of conformity and CE marking. Cameras without radio modules are subject to the EMC Directive (2014/30/EU) on electromagnetic compatibility and the Low Voltage Directive (2014/35/EU). The WEEE 2 Directive (2012/19/EU) imposes obligations regarding the collection and recycling of waste electronic equipment - the importer must register in the national WEEE register and finance the collection system. CBAM does not apply to cameras and electronic devices in Chapter 85. Import requires an EORI number and a correct customs declaration with the appropriate CN code.

Customs duties and ITA for cameras under subheading 8525 89

Current MFN customs duty rates for subheading 8525 89 should be verified in the European Commission's TARIC database. Television and digital cameras may qualify for a 0% rate under the WTO Information Technology Agreement (ITA), particularly cameras for IT and computer systems. The ITA expansion of 2016 covered additional product categories including digital cameras. Preferential rates may be available under FTAs concluded by the EU, including EPA with Japan, CETA with Canada, EU-Korea, EVFTA with Vietnam and TCA with the United Kingdom.
