Die vZTA ist eine amtliche Entscheidung der EU-Zollbehörde zur Einreihung von Waren. Sie gilt 3 Jahre und ist in allen EU-Mitgliedstaaten verbindlich.
Einreihung und Identität der Unterposition KN 291462
Unterposition 291462 der Kombinierten Nomenklatur umfasst Coenzym Q10 - Ubidecarenon (INN: ubidecarenone), eine lipophile Chinonverbindung mit der Molekularformel C59H90O4 und der CAS-Nummer 303-98-0. Ubidecarenon ist ein natürlich vorkommendes Molekül, das von Lebewesen synthetisiert wird und als Redoxträger eine wesentliche Rolle in der mitochondrialen Atmungskette spielt. Die Unterposition KN 291462 wurde aus der breiteren Chinongruppe (früher unter 291469 erfasst) als eigenständige Unterposition ausgegliedert, um der wachsenden kommerziellen und pharmazeutischen Bedeutung dieser Verbindung Rechnung zu tragen. Im Handel tritt Ubidecarenon typischerweise als gelbes bis orangefarbenes kristallines Pulver in pharmazeutischer oder nutraceutischer Reinheitsqualität auf. Die Einreihung richtet sich nach den Anmerkungen zu Kapitel 29 und den Allgemeinen Vorschriften der KN. Coenzym Q10 als chemischer Stoff (KN 291462) ist von fertigen Humanpräparaten zu unterscheiden, die je nach Zubereitung und Verwendungszweck in Kapitel 21 oder 30 eingereiht werden. Bei Zweifeln empfiehlt sich die Beantragung einer vZTA.
Pharmazeutische und nutraceutische Anwendungen von Ubidecarenon
Coenzym Q10 der Unterposition 291462 wird hauptsächlich als Wirk- oder Hilfsstoff für die Herstellung von Nahrungsergänzungsmitteln und Arzneimitteln eingeführt. In der Medizin wird Ubidecarenon als aktiver Bestandteil in Präparaten zur unterstützenden Behandlung von Herzinsuffizienz und neurodegenerativen Erkrankungen eingesetzt. Als Bestandteil von Nahrungsergänzungsmitteln unterliegt es in der EU der Richtlinie 2002/46/EG über Nahrungsergänzungsmittel - das Fertigprodukt muss die Kennzeichnungs- und Sicherheitsanforderungen des EU-Lebensmittelrechts und der massgeblichen nationalen Vorschriften des Vermarktungsmitgliedstaats erfüllen. Einführer von Bulkware für die Supplement-Herstellung sollten sicherstellen, dass der Hersteller nach Grundsätzen der guten Herstellungspraxis (GMP) arbeitet. In der Kosmetikbranche ist Ubidecarenon ein weit verbreiteter antioxidativer Wirkstoff in Anti-Aging-Cremes.
