Klassifizierungsumfang der Unterposition 2505 10
Die Unterposition 2505 10 der Kombinierten Nomenklatur umfasst Quarzsande und natürliche Kieselsande. Die Einreihung in diese Unterposition basiert auf Kriterien der Anmerkungen zu Kapitel 25 der Kombinierten Nomenklatur (KN), abgeleitet vom Harmonisierten System (HS) der Weltzollorganisation. Position 2505 bildet den Klassifizierungsrahmen, innerhalb dessen die Unterposition 2505 10 eine bestimmte Warenkategorie auf Grundlage physikalischer, chemischer oder funktionaler Merkmale identifiziert. Einführer sollten besonders auf die Abgrenzung von benachbarten Unterpositionen innerhalb der Position 2505 achten, da Unterschiede in technischen Parametern zu einer anderen Tarifeinreihung mit anderen Zollsätzen und Handelsmaßnahmen führen können. Die Einreihung erfolgt nach den Allgemeinen Vorschriften für die Auslegung der Kombinierten Nomenklatur (AV), insbesondere Regeln 1 und 6. Bei Einreihungszweifeln wird eine verbindliche Zolltarifauskunft (vZTA) der zuständigen Zollbehörde empfohlen.
Einfuhranforderungen für Unterposition 2505 10
Die Einfuhr von Waren der Unterposition 2505 10 in die Europäische Union erfordert die Einhaltung des Unionszollkodex (Verordnung (EU) Nr. 952/2013). Der Einführer muss über eine EORI-Nummer (Economic Operators Registration and Identification) verfügen und eine Zollanmeldung auf dem Formular SAD oder elektronisch über das AIS/IMPORT-System abgeben. Erforderliche Dokumente umfassen: Handelsrechnung mit Warenbeschreibung, Frachtdokument (CMR, B/L oder AWB), Warenspezifikation und Ursprungszeugnis, wenn der Einführer Präferenzzollsätze im Rahmen von Freihandelsabkommen nutzen möchte. Die Einfuhr von Mineralien und Steinen des Kapitels 25 erfordert die Einhaltung des Unionszollkodex. Die REACH-Verordnung (EG) Nr. 1907/2006 kann für bestimmte Mineralien gelten. Die Bauproduktenverordnung (EU) Nr. 305/2011 gilt für Bausteine. Produkte des Kapitels 25 unterliegen grundsätzlich nicht dem CBAM, mit Ausnahme von Zement (Position 2523). Aktuelle Anforderungen sind im TARIC-System der Europäischen Kommission zu überprüfen. Je nach Warenart können zusätzliche Zertifikat- und Konformitätserklärungsanforderungen gelten. Der Einführer sollte Dokumentation zur Identifizierung des Lieferanten und der Abnehmer in der Lieferkette führen.
Zölle und Handel für Unterposition 2505 10
Die MFN-Zollsätze (Meistbegünstigung) für Waren der Unterposition 2505 10 sind in der aktuellen TARIC-Datenbank der Europäischen Kommission zu überprüfen, da sie Änderungen unterliegen können. Präferenzzollsätze können im Rahmen von Freihandelsabkommen der EU verfügbar sein, darunter CETA (Kanada), EPA (Japan), Abkommen mit Südkorea, dem Vereinigten Königreich (TCA) und im Rahmen des Allgemeinen Präferenzsystems (APS) für Entwicklungsländer. Voraussetzung für die Präferenzbehandlung ist die Erfüllung der Ursprungsregeln und die Vorlage eines gültigen Ursprungsnachweises (EUR.1, Erklärung auf der Rechnung, REX). Der Einführer sollte TARIC auch auf etwaige Antidumping-, Ausgleichszölle oder andere Handelsbeschränkungen für das Produkt und Ursprungsland prüfen. Einfuhren aus Russland und Belarus können Beschränkungen aus EU-Sanktionspaketen unterliegen. Bei der Einfuhr wird Einfuhrumsatzsteuer zum nationalen Satz erhoben.
