Definition and scope of subheading 8539 39
Subheading 8539 39 is the residual subheading covering discharge lamps not classified under 8539 31 (linear fluorescent) or 8539 32 (CFL). It covers high-pressure sodium lamps (HPS), high-pressure mercury lamps, metal halide lamps, xenon projection lamps and specialist discharge lamps used in street, industrial, stadium and cinema lighting.
Ecodesign and LED transition
Many discharge lamps under 8539 39 are being phased out under Ecodesign regulations. High-pressure mercury lamps have been phased out. HPS and metal halide lamps are subject to gradual restrictions. Specialist lamps may benefit from exemptions. RoHS 2 restricts mercury. WEEE 2 covers collection. CBAM does not apply.
Duty rates for subheading 8539 39
MFN rates in TARIC. The discharge lamp market is transitioning to LED. Preferential rates under FTAs. VAT is charged.
