BTI (Binding Tariff Information) is an official EU customs decision confirming the classification of goods. Valid for 3 years, binding across all EU member states.

Definition and scope of CN subheading 842111

CN subheading 842111 covers centrifuges for cream separation, including cream separators and milk clarifiers used in the dairy industry. These centrifuges use centrifugal force to separate milk into fractions of different densities, enabling separation of cream from skimmed milk. Classification follows the General Rules for the Interpretation (GRI) of the Combined Nomenclature, particularly rules 1 and 6. Subheading 842111 falls under heading 8421, which covers centrifuges and filtering apparatus. The key classification criterion is the intended use for dairy processing, distinguishing it from other centrifuges (842119) used in other industries. Laboratory centrifuges for milk may also be classified under this subheading. Milk pasteurisation equipment is classified separately under subheading 841989. For borderline cases Binding Tariff Information (BTI) ruling is recommended.

Import requirements and regulations for cream separators (842111)

Importing cream separators under subheading 842111 into the European Union requires compliance with the Union Customs Code and regulations on machinery safety and food hygiene. The Machinery Regulation (EU) 2023/1230 imposes safety requirements including protection against access to rotating parts, rotor balancing and emergency stop systems. CE marking and an EU declaration of conformity are mandatory. Centrifuges in contact with milk must comply with Regulation (EC) No 1935/2004 on materials intended for food contact. Construction materials, typically food-grade stainless steel, must meet hygiene standards. The importer must hold an EORI number and file a customs declaration. Documentation includes commercial invoice, technical specifications, conformity certificates and food-contact compliance documents. MFN and preferential duty rates should be verified in TARIC.

Applications and market for cream separators (842111)

Cream separators classified under subheading 842111 are key equipment in dairy processing plants. Cream separators separate milk fat from milk, enabling production of cream of varying fat content as well as skimmed and semi-skimmed milk. Milk clarifiers remove mechanical impurities and somatic cells from raw milk. Modern dairy centrifuges can process tens of thousands of litres per hour. Major manufacturers of dairy centrifuges include companies from Sweden, Germany and Italy. Imports from these EU countries are not subject to customs duties within the single market, while imports from outside the EU are subject to MFN rates. Spare parts for dairy centrifuges are classified under subheading 842191. Importers should check availability of preferential rates under FTA agreements for imports from third countries. Used centrifuges require additional verification of technical condition and compliance with current standards.

Cream separators - EU food hygiene requirements

CN code 8421 11 covers cream separators. Import requires compliance with Machinery Directive 2006/42/EC and food hygiene requirements (Regulation EC 852/2004 and EC 1935/2004 for food contact). Materials in contact with food must meet EN standards for stainless steel and plastics. CE marking is mandatory.

Frequently asked questions

What hygiene requirements apply to cream separators under subheading 842111?
Cream separators must comply with Regulation (EC) No 1935/2004 on materials intended for food contact. Construction materials in contact with milk must be food-grade stainless steel or another material approved for food contact. Contact surfaces must be smooth, easy to clean and disinfect. Centrifuges must meet the hygiene standards applicable to dairy processing equipment.
How to distinguish cream separators (842111) from other centrifuges (842119)?
Subheading 842111 covers exclusively centrifuges intended for cream separation from milk, including cream separators and milk clarifiers. Other centrifuges used in chemical, pharmaceutical, petrochemical and other industries are classified under subheading 842119. The decisive factor is the intended use for dairy processing. For borderline cases a BTI ruling is recommended.
Does importing used cream separators involve additional requirements?
Importing used cream separators requires verification of compliance with current Machinery Regulation (EU) 2023/1230 and food-contact requirements. Used machines must meet applicable safety standards. The importer bears responsibility for ensuring the imported equipment complies with EU regulations. Documentation should include technical inspection certificates and confirmation of hygienic condition.
What are the import requirements for cream separators CN 8421 11?
Importing cream separators CN 8421 11 requires Machinery Directive 2006/42/EC compliance, CE marking and declaration of conformity. TARIC sets the duty rates. Additional sector-specific requirements may apply.
