Tarifeinreihung und Umfang des KN-Codes 640219
Der KN-Code 640219 umfasst Sportschuhe mit Oberteil aus Kautschuk oder Kunststoff und Laufsohle aus Kautschuk oder Kunststoff, die nicht die für Position 6401 charakteristische wasserdichte Einheitskonstruktion aufweisen. Diese Unterposition umfasst Sportschuhe mit Ausnahme von Ski- und Snowboardschuhen (640211/640212), darunter Fußballschuhe mit Kunststoffstollen, Leichtathletikschuhe mit Kunststoffspikes, Sportsandalen mit synthetischem Oberteil und Tennisschuhe mit Kunststoffoberteil. Das entscheidende Einreihungskriterium ist das Oberteilmaterial, das überwiegend aus Kautschuk oder Kunststoff bestehen muss. Wenn das Oberteil Textilmaterialien enthält, die mehr als 50 Prozent der Außenfläche ausmachen, wird der Schuh in Position 6404 eingereiht. Die Laufsohle muss aus Kautschuk, Kunststoff oder einer Kombination davon bestehen. Zollbehörden beurteilen den sportlichen Charakter anhand von Konstruktionsmerkmalen wie Stollen, Spikes, Dämpfungssystemen oder speziellen Verstärkungen.
Einfuhrvorschriften und Sicherheitsanforderungen
Die Einfuhr von Sportschuhen unter KN-Code 640219 in die EU unterliegt der Verordnung über die allgemeine Produktsicherheit (GPSR) (EU) 2023/988. Der Einführer muss die Produktsicherheit überprüfen und die Einhaltung der EU-Normen sicherstellen. Zollkontrollen bei Sportschuhen umfassen häufig die Prüfung geistiger Eigentumsrechte aufgrund der hohen Fälschungsrate bei internationalen Sportmarken.
Praktische Aspekte der Einfuhr von Sportschuhen

Der entscheidende Faktor ist das Oberteilmaterial. KN-Code 640219 gilt für Sportschuhe mit Oberteil überwiegend aus Kautschuk oder Kunststoff. Code 640411 umfasst Sportschuhe mit Oberteil aus Textilmaterialien (Gewebe, Gestricke). Wenn mehr als 50 Prozent der Außenfläche des Oberteils aus Textilmaterialien bestehen, wird der Schuh unter Code 640411 eingereiht, selbst wenn die Sohle aus Kautschuk oder Kunststoff ist.
