Anwendungsbereich und Einreihungskriterien für Unterposition 401110
Unterposition 401110 der Kombinierten Nomenklatur erfasst neue Luftreifen aus vulkanisiertem Kautschuk für Personenkraftwagen einschließlich Kombis und Rennwagen. Das maßgebliche Einreihungskriterium ist die vorgesehene Fahrzeugkategorie, die anhand der technischen Konstruktion des Reifens, der Seitenwandkennzeichnungen und der Typgenehmigungsdokumentation bestimmt wird. Pkw-Reifen sind gekennzeichnet durch: metrische Größenangaben (z. B. 195/65R15, 225/45R17, 275/35ZR20) oder Zollangaben (z. B. P215/70R15 nach TRA-Standard), Tragfähigkeitsindizes in der Regel im Bereich 60–109 sowie Geschwindigkeitssymbole von T (190 km/h) bis Y (über 300 km/h). Unterposition 401110 umfasst ebenfalls: SUV- und Crossover-Reifen mit der Kennzeichnung XL oder Extra Load, Run-Flat-Reifen mit den Kennzeichnungen RFT/RSC/SSR/ZP und verstärkter Seitenwand für die Weiterfahrt nach einem Reifendruckverlust, Allwetter-, Sommer- und Winterreifen (3PMSF-Symbol) für Fahrzeuge der Kategorie M1 sowie Rennreifen für den Rennsport ohne ECE R30-Straßenzulassung (Slick- und Semi-Slick-Reifen). Nicht unter 401110 fallen: Kraftradreifen (Position 401200), Fahrradreifen (Position 4013), Reifen für leichte Anhänger sowie Transporterreifen mit der Kennzeichnung C auf der Seitenwand, die auf Nutzfahrzeuge hinweisen und gesondert eingereiht werden.
EU-Import - ECE R30, EPREL-Registrierung und regulatorische Konformität
Die Einfuhr neuer Pkw-Reifen (401110) in das Zollgebiet der EU erfordert die Einhaltung umfassender technischer und handelsrechtlicher Vorschriften. Die UN-Regelung ECE R30 (Einheitliche Vorschriften für die Genehmigung von Luftreifen für Kraftfahrzeuge und deren Anhänger) ist der verbindliche Typgenehmigungsrahmen für auf dem EU-Markt bereitgestellte Pkw-Reifen. ECE-R30-Prüfungen umfassen: Dauerhaltbarkeit, Wulstablösewiderstand, Hochgeschwindigkeitsleistung sowie - für Winterreifen - Schneehaftungseigenschaften (3PMSF-Qualifikationstest). Jeder Reifen muss das ECE-Genehmigungszeichen (E-Kennzeichen) auf der Seitenwand tragen, einschließlich Regelungsnummer und Genehmigungsnummer. Die Verordnung (EU) 2020/740 über die Reifenkennzeichnung (geändert durch VO (EU) 2021/1341) verpflichtet den Lieferanten - der auch ein Importeur sein kann, der Reifen unter eigenem Namen oder Warenzeichen bereitstellt - zur Registrierung jedes Reifenmodells in der EPREL-Datenbank vor der Bereitstellung. Das EPREL-Etikett für Pkw-Reifen (Klasse C1) muss ausweisen: Kraftstoffeffizienzklasse (A-E, basierend auf dem Rollwiderstand), Nasshaftungsklasse (A-E, basierend auf dem Nassbremsweg), externen Rollgeräuschpegel in dB mit Klasse (A, B oder C) sowie bei Winter- oder Allwetterreifen die entsprechenden Symbole und ggf. die Eisgriffklasse. Die REACH-Verordnung (EG) Nr. 1907/2006 beschränkt den PAK-Gehalt in aromatischen Verarbeitungsölen in Kautschukmischungen (Anhang XVII, Eintrag 50) - der Importeur muss eine Lieferantenerklärung zur Konformität vorhalten. In der TARIC-Datenbank sind vor jeder Abfertigung etwaige Antidumping- oder Überwachungsmaßnahmen für Pkw-Reifen aus bestimmten Ursprungsländern zu prüfen.
Zolltarifrechtliche Abgrenzung: 401110 gegenüber benachbarten Unterpositionen
Die korrekte Einreihung unter 401110 erfordert eine sorgfältige Abgrenzung von verwandten Unterpositionen. Das primäre Kriterium ist die vorgesehene Fahrzeugkategorie, die durch Seitenwandkennzeichnungen und Genehmigungsdokumentation identifiziert wird. Reifen für Busse und LKW werden unter 401120 (Tragfähigkeitsindex bis 121) oder höheren Unterpositionen eingereiht - mit TBR (Truck and Bus Radial) gekennzeichnete Reifen oder solche mit einem Tragfähigkeitsindex ab 122 fallen nicht in 401110. Transporterreifen (LCV) mit C-Kennzeichnung auf der Seitenwand (z. B. 195/65R16C) für Fahrzeuge der Kategorie N1 werden gesondert eingereiht. Kraftradreifen - erkennbar am MR-Symbol oder spezifischen TRA/ETRTO-Angaben - werden unter Position 401200 eingereiht. Reifen für Landwirtschafts-, Forst- und Baumaschinen fallen in weitere Unterpositionen der Position 4011. Sind in einer Sendung sowohl Pkw-Reifen (401110) als auch Nutzfahrzeug-/Transporterreifen enthalten, müssen diese auf getrennten Zolltarifzeilen angemeldet werden. Zollbehörden können das ECE-R30-Zertifikat, technische Datenblätter oder ETRTO/TRA-Größenangaben anfordern, um die Fahrzeugkategorie zu bestätigen. Im Zweifel empfiehlt sich die Einholung einer verbindlichen Zolltarifauskunft (vZTA/BTI), die drei Jahre lang in der gesamten EU gilt.
Reifen 401110 - Neue Luftreifen für P - Kennzeichnung und Einfuhr
Reifen unter KN-Code 4011 10 unterliegen der Verordnung (EU) 2020/740 zur Reifenkennzeichnung mit EPREL-Registrierung und Energielabel für Kraftstoffeffizienz, Nasshaftung und Geräuschklassen.
