Classification of water-based acrylic paints

CN code 320910 covers paints and varnishes (including enamels and lacquers) based on acrylic or vinyl polymers, dissolved or dispersed in an aqueous medium. Water-based acrylic paints are the most widely used decorative and industrial paints in Europe, including wall paints, facade coatings, floor paints and industrial coatings. They are characterised by low volatile organic compound (VOC) content, good adhesion and colour durability. Classification requires the binder to be acrylic or vinyl polymers and the dispersion medium to be water. Paints based on organic solvents are classified under other codes.

VOC Directive and REACH regulations

Paints under code 320910 are subject to the Decopaint Directive 2004/42/EC (VOC Directive), which sets maximum permissible VOC content for various categories of paints and varnishes. Water-based paints typically have lower VOC content than solvent-based paints. Paint ingredients are subject to REACH registration. Paints containing hazardous substances must be labelled in accordance with CLP and accompanied by a Safety Data Sheet. Transport of water-based paints is not subject to ADR in most cases. Decorative paints must comply with Regulation (EU) 2019/1020 on market surveillance.

Trade and customs procedures

Import of acrylic paints under CN code 320910 requires a commercial invoice with product description, Safety Data Sheet and VOC compliance documentation. Importers should check current duty rates in TARIC. Major suppliers include China, Turkey and Asian countries. Paints are not subject to CBAM or dual-use controls. Preferential duty rates may be available under trade agreements. Package labelling must comply with destination country requirements.

VOC standards and emission limits

When importing Acrylic polymer-based paints in water (CN 3209 10) into the EU, VOC content regulations under Directive 2004/42/EC must be considered. Decorative paints and automotive refinish products have established VOC limits. CLP classification requires appropriate GHS pictogram labelling on packaging. Pigments containing heavy metals (lead, cadmium, chromium VI) are subject to strict REACH restrictions (Annex XVII). Importers must have SDS sheets and ensure labelling complies with destination country regulations.

Frequently asked questions

What VOC limits apply to water-based acrylic paints?
Directive 2004/42/EC sets VOC limits for various paint categories. Matt wall paints may contain max. 30 g/l VOC, gloss paints max. 100 g/l. Water-based acrylic paints typically meet these limits comfortably. Importers must ensure compliance with applicable limits.
Do water-based paints require a Safety Data Sheet?
Yes. Water-based paints containing hazardous substances at concentrations requiring CLP classification must be accompanied by a Safety Data Sheet. Even paints not classified as hazardous may require an SDS if they contain REACH-registered ingredients.
How to distinguish paints under 320910 from solvent-based paint codes?
Code 320910 covers paints based on acrylic or vinyl polymers in an aqueous medium. Paints based on the same polymers in organic solvents are classified under code 320810. The key criterion is the dispersion medium - water versus organic solvent.
What VOC limits apply to paints and coatings CN 3209 10?
Paints and coatings under CN code 3209 10 are subject to VOC limits per Directive 2004/42/EC. Matt decorative paints: max 30 g/l, gloss decorative paints: max 100-150 g/l, industrial coatings: limits vary by application.
