Customs duties shall be suspended in respect of:(a) goods intended for incorporation in drilling or production platforms:(1) fixed, of subheading ex 8430 49, operating in or outside the territorial sea of Member States, or(2) floating or submersible, of subheading 8905 20, for the purposes of their construction, repair, maintenance or conversion, and in respect of goods intended for equipping the said platforms.(b) tubes, pipes, cables and their connection pieces, linking these drilling or production platforms to the mainland.

Classification and applications of phosphoric acid

CN code 280920 covers phosphoric acid (orthophosphoric acid, H3PO4) and polyphosphoric acids, including pyrophosphoric and metaphosphoric acid. Phosphoric acid is produced by the wet process (from phosphate rock) or the thermal process (from elemental phosphorus) and supplied as an aqueous solution typically at 75 to 85 per cent concentration. The substance has wide applications in the food industry as an acidity regulator (E338), in phosphate fertiliser production, in metal surface treatment and in the chemical industry. Tariff classification covers both technical and food-grade acid. Importers should indicate the acid concentration, intended use and quality grade in customs documentation, as these affect regulatory requirements.

REACH, CLP requirements and chemical safety

Phosphoric acid is subject to REACH registration (CAS 7664-38-2) and has a harmonised CLP classification as corrosive (Skin Corr. 1A, H314). CLP labelling requires the GHS05 pictogram, signal word and appropriate H and P statements. The Safety Data Sheet must be provided in the official language of the destination country. In international transport, phosphoric acid at concentrations above 80 per cent is classified as ADR dangerous goods Class 8, Packing Group III (UN 1805). Phosphoric acid is not an explosives precursor under Regulation (EU) 2019/1148. Importers of food-grade acid must additionally meet the requirements of Regulation (EC) No 178/2002 on food safety.

International trade and customs procedures
