Customs duties shall be suspended in respect of goods intended for incorporation in the ships, boats or other vessels classified at the following CN codes 8901 10 10; 8901 20 10; 8901 30 10; 8901 90 10; 8902 00 10; 8903 91 10; 8903 92 10; 8904 00 10; 8904 00 91; 8905 10 10; 8905 90 10; 8906 10 00; 8906 90 10 for the purposes of their construction, repair, maintenance or conversion, and in respect of goods intended for fitting to or equipping such ships, boats or other vessels.2. Customs duties shall be suspended in respect of:(a) goods intended for incorporation in drilling or production platforms:(1) fixed, of subheading ex 8430 49, operating in or outside the territorial sea of Member States, or(2) floating or submersible, of subheading 8905 20, for the purposes of their construction, repair, maintenance or conversion, and in respect of goods intended for equipping the said platforms.(b) tubes, pipes, cables and their connection pieces, linking these drilling or production platforms to the mainland.
EU003According to The Special Provisions of Section II (A) (3) of the Preliminary Provisions of the Combined Nomenclature the suspension of customs duties for goods for certain categories of ships, boats and other vessels and for drilling or production platforms shall be subject to conditions laid down in the relevant provisions of the European Union with a view to customs control of the use of such goods.

Einreihungsbereich der Unterposition 6914 10
Unterposition 6914 10 der Kombinierten Nomenklatur umfasst andere Keramikwaren aus Porzellan, die nicht in frühere Positionen des Kapitels 69 eingereiht werden können. Dazu gehören vor allem technische Porzellanerzeug nisse: elektrische und elektrotechnische Isolatoren, Isolierbuchsen, Labor- und Industriemuffeln, Porzellanführungen und -ringe, Elemente für Keramiköfen sowie andere technische Waren aus Porzellan. Porzellan im Sinne der Kombinierten Nomenklatur ist ein keramischer Werkstoff, der durch einen hohen Sinterungsgrad, Opazität oder Transluzenz der Masse, geringe Wasseraufnahme und eine weiße oder cremefarbene Bruchfläche gekennzeichnet ist. Unterposition 6914 10 gehört zur Position 6914 im Rahmen von Kapitel 69 (Keramische Waren) des Abschnitts XIII der Kombinierten Nomenklatur. Die Einreihung erfolgt nach den Allgemeinen Vorschriften für die Auslegung der KN, insbesondere den Vorschriften 1 und 6, sowie den Anmerkungen zu Kapitel 69. Entscheidend ist die Unterscheidung zwischen Waren aus Porzellan (Unterposition 6914 10) und Waren aus anderen keramischen Stoffen (Unterposition 6914 90) sowie von Waren, die als Erzeugnisse mit bestimmter Verwendung den Positionen 6904-6913 zuzuordnen sind. Im Zweifelsfall bezüglich der Einreihung von Porzellanerzeug nissen in Unterposition 6914 10 wird empfohlen, eine verbindliche Zolltarifauskunft (vZTA) bei der zuständigen Zollbehörde zu beantragen.
Einfuhranforderungen für Keramikwaren der Unterposition 6914 10
Die Einfuhr von Keramikwaren aus Porzellan der Unterposition 6914 10 in die Europäische Union erfordert die Einhaltung der Vorschriften des Unionszollkodex (Verordnung (EU) Nr. 952/2013). Der Einführer muss eine EORI-Nummer besitzen und eine Zollanmeldung mit dem korrekten KN-Code abgeben. Die erforderliche Dokumentation umfasst: eine Handelsrechnung mit detaillierter Warenbeschreibung (Warenart, Material, Verwendungszweck), ein Beförderungsdokument (CMR, B/L oder AWB), eine technische Spezifikation für Industrieerzeugnisse sowie ein Ursprungszeugnis, wenn der Einführer präferenzielle Zollsätze in Anspruch nehmen möchte. Technische Porzellanerzeugnisse, die in der Elektrotechnik eingesetzt werden, können den Anforderungen der Niederspannungsrichtlinie (2014/35/EU) oder der Richtlinie zur elektromagnetischen Verträglichkeit (2014/30/EU) unterliegen - in diesem Fall sind CE-Kennzeichnung und Konformitätserklärung erforderlich. Waren, die dazu bestimmt sind, mit Lebensmitteln in Berührung zu kommen, müssen der Verordnung (EG) Nr. 1935/2004 über Materialien und Gegenstände, die dazu bestimmt sind, mit Lebensmitteln in Berührung zu kommen, entsprechen, einschließlich der Grenzwerte für die Migration von Blei und Cadmium gemäß der Richtlinie 84/500/EWG. Aktuelle MFN-Zollsätze und geltende Handelsmaßnahmen sind in der TARIC-Datenbank der Europäischen Kommission zu prüfen.
Zollsätze und Handelsmaßnahmen für Unterposition 6914 10
Die MFN-Zollsätze für Keramikwaren aus Porzellan der Unterposition 6914 10 sind in der aktuellen TARIC-Datenbank der Europäischen Kommission zu prüfen, da sie Änderungen unterliegen können. Präferenzzollsätze können im Rahmen von Freihandelsabkommen der EU verfügbar sein, darunter CETA (Kanada), das EU-Japan-Wirtschaftspartnerschaftsabkommen, das EU-Südkorea-Abkommen, das EU-UK-Handels- und Kooperationsabkommen sowie das Allgemeine Präferenzsystem (APS) für Entwicklungsländer. Voraussetzung für die Inanspruchnahme von Präferenzen ist die Einhaltung der Ursprungsregeln und die Vorlage eines gültigen Ursprungsnachweises (Warenverkehrsbescheinigung EUR.1, Ursprungserklärung auf der Rechnung oder REX-Erklärung). Der Einführer sollte in TARIC prüfen, ob Antidumping- oder Ausgleichsmaßnahmen für das jeweilige Ursprungsland gelten - aus China eingeführte Keramikwaren können je nach genauer Einreihung solchen Maßnahmen unterliegen. Für bestimmte technische Porzellanwaren können zudem Zollaussetzungen oder Zollkontingente gelten, die dem Einführer günstigere Zollsätze ermöglichen. Diese sind ebenfalls in TARIC zu prüfen und erfordern gegebenenfalls Lizenzanträge oder Warencodes für Kontingentszwecke. Einfuhren aus Russland und Belarus können Einschränkungen aufgrund der geltenden EU-Sanktionspakete unterliegen. Bei der Einfuhr wird Mehrwertsteuer nach dem inländischen Steuersatz erhoben. Der Einführer ist für die korrekte Einreihung und vollständige Zollanmeldung verantwortlich. Alle aktuellen Zollsätze und Handelsmaßnahmen sind im TARIC-System zu prüfen.
