Definition and scope of subheading 8517 18 — other telephone sets

Subheading 8517 18 of the Combined Nomenclature covers other telephone sets not classified under subheadings 8517 11 to 8517 14. In commercial practice, this subheading encompasses cordless DECT telephones for home and office use, stationary video phones with camera and display, video conferencing terminals, satellite phones, onboard telephones for aircraft and ships, intercom telephone sets and other specialised telephony devices. The essential classification criterion is the telephone function (enabling voice communication) in a device not falling under subheadings 8517 11 (corded line phones), 8517 13 (smartphones) or 8517 14 (other mobile phones). Video conferencing systems consisting of multiple devices may be classified as sets or as separate components. PBX switchboards are classified under subheading 8517 62. Classification is based on GRI Rules 1 and 6.

Regulatory requirements for apparatus under subheading 8517 18

Telephone apparatus under subheading 8517 18 placed on the EU market are subject to various directives depending on the device type. Cordless DECT phones and other radio devices are subject to the Radio Equipment Directive RED (2014/53/EU) requiring CE marking. Wired VoIP phones without radio modules are subject to LVD (2014/35/EU) and EMC (2014/30/EU). The RoHS 2 Directive (2011/65/EU) restricts hazardous substances. The WEEE 2 Directive (2012/19/EU) requires waste collection registration. Satellite phones are subject to additional regulatory requirements regarding satellite spectrum use. The GPSR Regulation (EU) 2023/988 requires EU representative designation. CBAM does not apply to telecommunications equipment from Chapter 85. Under the ITA, telephone sets may benefit from a 0% duty rate.

Duty rates and import conditions for apparatus under subheading 8517 18

Current MFN duty rates for apparatus under subheading 8517 18 should be verified in TARIC. Telephone sets as telecommunications equipment under the ITA may benefit from a 0% MFN rate. Preferential FTA rates may provide additional benefits. Major DECT phone manufacturers include China, Germany, France and Japan. Import documentation includes commercial invoice with technical specifications, transport documents, EORI number, CE declaration of conformity with RED or LVD/EMC, RoHS documentation and WEEE data. For satellite phones, additional frequency licensing requirements may apply. National VAT is levied on import.

RED directive and telecom equipment 8517 18

Telecom equipment under CN 8517 18 is subject to RED 2014/53/EU if it emits or receives radio waves. From 2025, smartphones and tablets require USB-C charging. MFN duty: 0% (ITA). Devices must comply with LVD, EMC and RoHS 2. Cybersecurity of connected devices is regulated by the Cyber Resilience Act (EU) 2024/2847.

Are DECT phones classified under subheading 8517 18?
Yes. Cordless DECT (Digital Enhanced Cordless Telecommunications) phones for home and office use are classified under subheading 8517 18 as other telephone sets. DECT phones are not mobile phones (8517 13 or 8517 14) because they operate in a dedicated DECT frequency band and connect to a base station linked to a fixed network, not to a cellular network.
